Polas (polas.app) is software as a service for photographers, photo studios and schools. It is provided by Victor Alberto Luna Just, tax ID (CUIT) 20-27181321-0, located in Oldman 704, Loma Verde, Escobar (CP 1625), provincia de Buenos Aires, Argentina (“Polas”, “we” or “us”).

These terms govern the use of the website, the admin panel (admin.polas.app), the desktop app and the galleries published with Polas. By creating an account or purchasing a plan you accept these terms. If you do not agree, do not use the service.

The service

Polas is a tool for delivering and selling photos. Depending on the plan, it includes:

  • a web panel to organize shoots, schools, classes, orders and clients;
  • a desktop app for bulk photo upload and download;
  • branded online galleries on a polas.app subdomain or on your own domain;
  • face recognition search so each family can find their photos;
  • email campaigns, order management and print-lab orders;
  • for schools, student rosters and private galleries by class.

What you purchase is access to the software. Polas does not sell photographs or printed products: the photographer is the seller (see “Sales to your clients”).

Your account

  • You must be of legal age and able to enter into a contract.
  • If you use Polas on behalf of a studio, company or school, you represent that you are authorized to bind it.
  • You are responsible for keeping your credentials confidential and for the activity of anyone you give access to your account.

Plans, prices and payments

Plans and prices are published at polas.app/precios. Prices are in US dollars (USD); depending on your country, taxes may be added and are shown before you pay.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle issues the invoice, collects applicable taxes, handles billing inquiries and processes refunds. When you pay, you also accept Paddle's buyer terms.

Each plan may combine three charges:

  • Subscription fee. An annual contract paid in a single payment or in 12 monthly installments. It renews automatically at the end of the term unless you cancel before.
  • Commission. A percentage of what you sell to your clients through Polas. It is calculated only on products actually paid for, excluding shipping, taxes, payment processing fees and refunded orders. It is settled once a month and charged to your payment method on file; sales in Argentine pesos are converted to US dollars at the exchange rate of the settlement date. If the monthly amount is below US$10, it rolls over to the next month.
  • Extra storage. If you exceed the storage included in your plan, it is charged per TB per month at the published price. We notify you before it starts.

If a plan includes a free trial, the selected plan is charged automatically when the trial ends unless you cancel before.

If a payment fails, you have 7 days to fix it. After that, the account moves to the free Inicio plan, with its limits, without losing your data.

If we change a plan's price, we will email you at least 30 days in advance. The new price applies from your next renewal, never to a period you have already paid for.

Plan changes and cancellation

  • You can cancel at any time from Settings → Plan and billing, or by emailing us.
  • When you cancel, your plan stays active until the end of the paid period. If you pay in installments, it stays active until the next installment date, which is no longer charged. After that, the account moves to the free Inicio plan.
  • Upgrading from Inicio to a paid plan is immediate. Other changes take effect at the end of the paid period, without proration.
  • Commission and extra storage already accrued are charged even if you cancel.

Refunds

You may request a full refund of the subscription fee within 14 days of the first payment of the contract or of its renewal. Full conditions are in our Refund Policy.

Sales to your clients

When you sell photos or products to your clients (for example, to the families of a school), the sale is between you and your client. Your clients pay through your own Mercado Pago account or the payment method you set up, and the money goes to your account, not to a Polas account. Polas is not a party to those transactions.

You are responsible for the prices you set, for delivering what you sell, for handling your clients' claims and refunds, and for issuing your own receipts and meeting your tax obligations.

Your content

  • The photographs and files you upload remain yours. You grant us only the license needed to host, process and display them to the people you authorize, in order to provide the service.
  • By uploading content you represent that you hold the necessary rights and permissions. When minors are photographed, obtaining consent from the families or the institution is your responsibility.
  • You decide whether to enable face recognition search in each gallery. The selfie a family uses to search for their photos is not stored.
  • We may remove content that is clearly illegal or violates these terms.

Acceptable use

  • You may not use Polas for illegal, defamatory or offensive activities, or to infringe third-party rights.
  • You may not attempt to access other accounts or data, interfere with the service, or copy, resell or modify the software.

If you seriously or repeatedly breach these terms, we may suspend or close your account, with prior notice unless there is a risk to the service or to third parties.

File retention

On the free Inicio plan, photos remain available for 150 days, and we notify you 30, 7 and 1 day before deleting the originals; moving to a paid plan stops the deletion. On paid plans, photos are kept while the plan is active. We recommend always keeping your own copy of your originals.

Availability and liability

We make reasonable efforts to keep the service available, but we do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect, incidental or special damages or lost profits, and our total liability is limited to the amount you paid us in the 12 months before the event giving rise to it.

Nothing above limits liability that cannot be excluded by law, or your rights as a consumer.

Privacy

Personal data is handled according to our Privacy Policy.

Changes to these terms

We may update these terms. We change the date at the top and, for significant changes, notify you in advance at your account email. Continued use means you accept them.

Governing law

These terms are governed by the laws of Argentina. Any dispute is subject to the ordinary courts of the City of Buenos Aires, without prejudice to the rights consumer protection law grants you.

This English version is provided for convenience. If it differs from the Spanish version, the Spanish version prevails.
